SUBJECT:      Strike everything amendment to H.B. 2105, relating to ASRS; elected official

Purpose

 

Allows an elected official who participates in the Arizona State Retirement System (ASRS) to commence retirement without terminating employment.

 

Background

 

An elected official who is an active, an inactive or a retired member of ASRS or a member of ASRS with a disability, may elect not to participate in the Elected Officials' Retirement Plan (EORP), but continue in ASRS if the member's employer is a participating employer.

 

In current statute, at an ASRS member's election, a retired member may return to work and still be eligible to receive a retirement benefit if the following requirements are satisfied: 1) the retired member has attained the member's normal retirement age; and 2) the retired member terminated direct employment with an employer at least 365 consecutive days before returning to work.

 

There is no fiscal impact to the state General Fund associated with this legislation.

 

Provisions

 

1.      Allows an elected official who participates in ASRS to commence retirement, on a date selected by the elected official after submitting a completed retirement application to ASRS, without terminating employment.

 

2.      Stipulates that an elected official who is a member of ASRS and who returns to work or continues working, is still eligible to receive ASRS retirement benefits.

 

3.      Contains technical and conforming changes.

 

4.      Becomes effective on the general effective date.
